(א) וַיֹּ֤אמֶר יהוה אֶל־מֹשֶׁ֔ה אֱמֹ֥ר אֶל־הַכֹּהֲנִ֖ים בְּנֵ֣י אַהֲרֹ֑ן וְאָמַרְתָּ֣ אֲלֵהֶ֔ם לְנֶ֥פֶשׁ לֹֽא־יִטַּמָּ֖א בְּעַמָּֽיו׃ (ב) כִּ֚י אִם־לִשְׁאֵר֔וֹ הַקָּרֹ֖ב אֵלָ֑יו לְאִמּ֣וֹ וּלְאָבִ֔יו וְלִבְנ֥וֹ וּלְבִתּ֖וֹ וּלְאָחִֽיו׃ (ג) וְלַאֲחֹת֤וֹ הַבְּתוּלָה֙ הַקְּרוֹבָ֣ה אֵלָ֔יו אֲשֶׁ֥ר לֹֽא־הָיְתָ֖ה לְאִ֑ישׁ לָ֖הּ יִטַּמָּֽא׃ (ד) לֹ֥א יִטַּמָּ֖א בַּ֣עַל בְּעַמָּ֑יו לְהֵ֖חַלּֽוֹ׃ (ה) לֹֽא־[יִקְרְח֤וּ](יקרחה) קׇרְחָה֙ בְּרֹאשָׁ֔ם וּפְאַ֥ת זְקָנָ֖ם לֹ֣א יְגַלֵּ֑חוּ וּבִ֨בְשָׂרָ֔ם לֹ֥א יִשְׂרְט֖וּ שָׂרָֽטֶת׃ (ו) קְדֹשִׁ֤ים יִהְיוּ֙ לֵאלֹ֣הֵיהֶ֔ם וְלֹ֣א יְחַלְּל֔וּ שֵׁ֖ם אֱלֹהֵיהֶ֑ם כִּי֩ אֶת־אִשֵּׁ֨י יהוה לֶ֧חֶם אֱלֹהֵיהֶ֛ם הֵ֥ם מַקְרִיבִ֖ם וְהָ֥יוּ קֹֽדֶשׁ׃ (ז) אִשָּׁ֨ה זֹנָ֤ה וַחֲלָלָה֙ לֹ֣א יִקָּ֔חוּ וְאִשָּׁ֛ה גְּרוּשָׁ֥ה מֵאִישָׁ֖הּ לֹ֣א יִקָּ֑חוּ כִּֽי־קָדֹ֥שׁ ה֖וּא לֵאלֹהָֽיו׃ (ח) וְקִ֨דַּשְׁתּ֔וֹ כִּֽי־אֶת־לֶ֥חֶם אֱלֹהֶ֖יךָ ה֣וּא מַקְרִ֑יב קָדֹשׁ֙ יִֽהְיֶה־לָּ֔ךְ כִּ֣י קָד֔וֹשׁ אֲנִ֥י יהוה מְקַדִּשְׁכֶֽם׃ (ט) וּבַת֙ אִ֣ישׁ כֹּהֵ֔ן כִּ֥י תֵחֵ֖ל לִזְנ֑וֹת אֶת־אָבִ֙יהָ֙ הִ֣יא מְחַלֶּ֔לֶת בָּאֵ֖שׁ תִּשָּׂרֵֽף׃ {ס}(י) וְהַכֹּהֵן֩ הַגָּד֨וֹל מֵאֶחָ֜יו אֲֽשֶׁר־יוּצַ֥ק עַל־רֹאשׁ֣וֹ ׀ שֶׁ֤מֶן הַמִּשְׁחָה֙ וּמִלֵּ֣א אֶת־יָד֔וֹ לִלְבֹּ֖שׁ אֶת־הַבְּגָדִ֑ים אֶת־רֹאשׁוֹ֙ לֹ֣א יִפְרָ֔ע וּבְגָדָ֖יו לֹ֥א יִפְרֹֽם׃ (יא) וְעַ֛ל כׇּל־נַפְשֹׁ֥ת מֵ֖ת לֹ֣א יָבֹ֑א לְאָבִ֥יו וּלְאִמּ֖וֹ לֹ֥א יִטַּמָּֽא׃ (יב) וּמִן־הַמִּקְדָּשׁ֙ לֹ֣א יֵצֵ֔א וְלֹ֣א יְחַלֵּ֔ל אֵ֖ת מִקְדַּ֣שׁ אֱלֹהָ֑יו כִּ֡י נֵ֠זֶר שֶׁ֣מֶן מִשְׁחַ֧ת אֱלֹהָ֛יו עָלָ֖יו אֲנִ֥י יהוה׃
(1) GOD said to Moses: Speak to the priests, the sons of Aaron, and say to them:
None shall defile himself for any [dead] person among his kin, (2) except for the relatives that are closest to him: his mother, his father, his son, his daughter, and his brother; (3) also for a virgin sister, close to him because she has not become someone’s [wife], for her he may defile himself. (4) But he shall not defile himself as a kinsman by marriage, and so profane himself. (5) They shall not shave smooth any part of their heads, or cut the side-growth of their beards, or make gashes in their flesh. (6) They shall be holy to their God and not profane the name of their God; for they offer the ETERNAL’s offerings by fire, the food of their God, and so must be holy. (7) They shall not marry a woman defiled by prostitution, nor shall they marry one divorced from her husband. For they are holy to their God (8) and you must treat them as holy, since they offer the food of your God; they shall be holy to you, for I GOD who sanctify you am holy. (9) When the daughter of a priest defiles herself through prostitution, it is her father whom she defiles; she shall be put to the fire. (10) The priest who is exalted above his fellows, on whose head the anointing oil has been poured and who has been ordained to wear the vestments, shall not bare his head or rend his vestments. (11) He shall not go in where there is any dead body; he shall not defile himself even for his father or mother. (12) He shall not go outside the sanctuary and profane the sanctuary of his God, for upon him is the distinction of the anointing oil of Mine, the ETERNAL’s.
בני אהרן. יָכוֹל חֲלָלִים תַּ"ל הַכֹּהֲנִים:
בני אהרן THE SONS OF AARON — One might think that חללים (priests who have lost their priestly status for reasons connected with their birth or marriage) also may not defile themselves by the dead, Scripture therefore states, "Say unto the priests", — thus only those sons of Aaron are included who have not lost their priestly character; consequently חללים are excluded (Sifra, Emor, Section 1 1) .
קדשים יהיו. עַל כָּרְחָם יַקְדִּישׁוּם בֵּית דִּין בְּכָךְ (ספרא):
קדשים יהיו THEY SHALL BE HOLY — even against their will — the court shall force them to remain holy in respect to this (Sifra, Emor, Chapter 1 6).
וקדשתו. עַל כָּרְחוֹ, שֶׁאִם לֹא רָצָה לְגָרֵשׁ הַלְקֵהוּ וְיַסְּרֵהוּ עַד שֶׁיְּגָרֵשׁ (ספרא; יבמות פ"ח):
וקדשתו THOU SHALT SANCTIFY HIM — even against his will; it means that if he is not willing to divorce the woman whom he had illegally married flog him (מלקות ארבעים) and chastise him (מכות מרדות) until he divorces her (Sifra, Emor, Chapter 1 13; Yevamot 88b).
קדש יהיה לך. נְהֹג בּוֹ קְדֻשָּׁה, לִפְתֹּחַ רִאשׁוֹן בְּכָל דָּבָר וּלְבָרֵךְ רִאשׁוֹן בַּסְּעוּדָה (הוריות י"ב):
קדש יהיה לך HE SHALL BE HOLY UNTO THEE — holy unto thee: treat him with sanctity (as someone holy) — that he should be the first in all holy matters (e. g., the reading of the law) and that he should have the first right to recite the benedictions at a meal (המוציא and ברכת המזון) (Gittin 59b; cf. Rashi on Nedarim 62b).
לא יפרע. לֹא יְגַדֵּל פֶּרַע עַל אֵבֶל, וְאֵיזֶהוּ גִּדּוּל פֶּרַע? יוֹתֵר מִשְּׁלוֹשִׁים יוֹם (שם):
לא יפרע [THE HAIR OF HIS HEAD] SHALL HE NOT DISARRANGE — i.e. he shall not let his hair grow wild on account of ritual mourning for the death of a near relative (Sifra). And what is called "letting the hair grow wild”? Leaving it uncut for more than 30 days (Sanhedrin 22b).
ומן המקדש לא יצא. אֵינוֹ הוֹלֵךְ אַחַר הַמִּטָּה (סנהדרין י"ח), וְעוֹד מִכָּאן לָמְדוּ רַבּוֹתֵינוּ שֶׁכֹּהֵן גָּדוֹל מַקְרִיב אוֹנֵן, וְכֵן מַשְׁמָעוֹ: אַף אִם מֵתוּ אָבִיו וְאִמּוֹ אֵינוֹ צָרִיךְ לָצֵאת מִן הַמִּקְדָּשׁ אֶלָּא עוֹבֵד עֲבוֹדָה:
ומן המקדש לא יצא NEITHER SHALL HE GO OUT FROM THE SANCTUARY — This means that he must not follow the bier (attend the funeral of his father or mother) (Sanhedrin 18a). Our Rabbis further derived from this (Sanhedrin 84a) the Halacha that the High Priest may perform the sacrificial rites when an “Onan”. The following is how this is implied: even if his father or his mother died he is not required to leave the Sanctuary as may be assumed, but may perform the service;
מֵת לוֹ מֵת, אֵינוֹ יוֹצֵא אַחַר הַמִּטָּה, אֶלָּא הֵן נִכְסִין וְהוּא נִגְלֶה, הֵן נִגְלִין וְהוּא נִכְסֶה, וְיוֹצֵא עִמָּהֶן עַד פֶּתַח שַׁעַר הָעִיר, דִּבְרֵי רַבִּי מֵאִיר.
If a relative of the High Priest dies, he does not follow the bier carrying the corpse, since it is prohibited for the High Priest to become ritually impure even for immediate relatives (see Leviticus 21:11). Rather, once the members of the funeral procession are concealed from sight by turning onto another street, he is revealed on the street they departed, and when they are revealed, then he is concealed, and in this way, he goes out with them until the entrance of the gate of the city, from where they would take out the corpse, since the dead were not buried in Jerusalem. This is the statement of Rabbi Meir.
(יג) וְה֕וּא אִשָּׁ֥ה בִבְתוּלֶ֖יהָ יִקָּֽח׃ (יד) אַלְמָנָ֤ה וּגְרוּשָׁה֙ וַחֲלָלָ֣ה זֹנָ֔ה אֶת־אֵ֖לֶּה לֹ֣א יִקָּ֑ח כִּ֛י אִם־בְּתוּלָ֥ה מֵעַמָּ֖יו יִקַּ֥ח אִשָּֽׁה׃ (טו) וְלֹֽא־יְחַלֵּ֥ל זַרְע֖וֹ בְּעַמָּ֑יו כִּ֛י אֲנִ֥י יהוה מְקַדְּשֽׁוֹ׃ {ס}
(13) He may marry only a woman who is a virgin. (14) A widow, or a divorced woman, or one who is degraded by prostitution—such he may not marry. Only a virgin of his own kin may he take to wife— (15) that he may not profane his offspring among his kin, for I GOD have sanctified him.
Some scholars have suggested that the “profane” woman is a cultic prostitute.[23] However, most contemporary scholars reject the idea that cultic prostitution existed in the ancient Near East,[24] and in any case, it is not clear why a cultic prostitute would be less problematic than an ordinary prostitute.
Others derive the term חֲלָלָה from the root חלל meaning “to pierce” (a homonym of the root חלל meaning “to be profane”). According to this interpretation, the term refers to a “penetrated” woman, either any non-virgin or a woman who has been raped.[25] But only the high priest is required to marry a virgin, and there is no evidence in the Bible that a woman who was raped had a different status from a woman who had sex willingly. (טז) וַיְדַבֵּ֥ר יהוה אֶל־מֹשֶׁ֥ה לֵּאמֹֽר׃ (יז) דַּבֵּ֥ר אֶֽל־אַהֲרֹ֖ן לֵאמֹ֑ר אִ֣ישׁ מִֽזַּרְעֲךָ֞ לְדֹרֹתָ֗ם אֲשֶׁ֨ר יִהְיֶ֥ה בוֹ֙ מ֔וּם לֹ֣א יִקְרַ֔ב לְהַקְרִ֖יב לֶ֥חֶם אֱלֹהָֽיו׃ (יח) כִּ֥י כׇל־אִ֛ישׁ אֲשֶׁר־בּ֥וֹ מ֖וּם לֹ֣א יִקְרָ֑ב אִ֤ישׁ עִוֵּר֙ א֣וֹ פִסֵּ֔חַ א֥וֹ חָרֻ֖ם א֥וֹ שָׂרֽוּעַ׃ (יט) א֣וֹ אִ֔ישׁ אֲשֶׁר־יִהְיֶ֥ה ב֖וֹ שֶׁ֣בֶר רָ֑גֶל א֖וֹ שֶׁ֥בֶר יָֽד׃ (כ) אֽוֹ־גִבֵּ֣ן אוֹ־דַ֔ק א֖וֹ תְּבַלֻּ֣ל בְּעֵינ֑וֹ א֤וֹ גָרָב֙ א֣וֹ יַלֶּ֔פֶת א֖וֹ מְר֥וֹחַ אָֽשֶׁךְ׃ (כא) כׇּל־אִ֞ישׁ אֲשֶׁר־בּ֣וֹ מ֗וּם מִזֶּ֙רַע֙ אַהֲרֹ֣ן הַכֹּהֵ֔ן לֹ֣א יִגַּ֔שׁ לְהַקְרִ֖יב אֶת־אִשֵּׁ֣י יהוה מ֣וּם בּ֔וֹ אֵ֚ת לֶ֣חֶם אֱלֹהָ֔יו לֹ֥א יִגַּ֖שׁ לְהַקְרִֽיב׃ (כב) לֶ֣חֶם אֱלֹהָ֔יו מִקׇּדְשֵׁ֖י הַקֳּדָשִׁ֑ים וּמִן־הַקֳּדָשִׁ֖ים יֹאכֵֽל׃ (כג) אַ֣ךְ אֶל־הַפָּרֹ֜כֶת לֹ֣א יָבֹ֗א וְאֶל־הַמִּזְבֵּ֛חַ לֹ֥א יִגַּ֖שׁ כִּֽי־מ֣וּם בּ֑וֹ וְלֹ֤א יְחַלֵּל֙ אֶת־מִקְדָּשַׁ֔י כִּ֛י אֲנִ֥י יהוה מְקַדְּשָֽׁם׃
(16) GOD spoke further to Moses: (17) Speak to Aaron and say: No man among your offspring throughout the ages who has a defect shall be qualified to offer the food of his God. (18) No one at all who has a defect shall be qualified: no man who is blind, or lame, or has a limb too short or too long; (19) no man who has a broken leg or a broken arm; (20) or who is a hunchback, or a dwarf, or who has a growth in his eye, or who has a boil-scar, or scurvy, or crushed testes. (21) No man among the offspring of Aaron the priest who has a defect shall be qualified to offer GOD’s offering by fire; having a defect, he shall not be qualified to offer the food of his God. (22) He may eat of the food of his God, of the most holy as well as of the holy; (23) but he shall not enter behind the curtain or come near the altar, for he has a defect. He shall not profane these places sacred to Me, for I GOD have sanctified them.
ואשה גרושה מאישה לא יקחו. כבר יורה היותה גרושה שנמצא בה דבר גנות ואין ראוי שיקח הכהן לאשה מי שלא הית' ראויה לאשה:
The fact that she was divorced shows that something negative about her was discovered, and it is not appropriate for a priest to marry a woman who did not befit an ordinary Israelite.
